Events in Gaza are rocking the international community and generating fierce arguments about international law. Charges that Israel is violating international law in its attack on Gaza are countered by Israeli government arguments that Israel's imperative of defence authorises military tactics that also kill and injure civilians. Israeli charges that Hamas is no more than a terrorist organisation are countered by arguments that Hamas is the elected government of the Palestinian Authority unjustly deprived of recognition. The status of Gaza itself, as occupied or no longer occupied, is also contested. As these and related questions have confused concerned observers, journalists and policymakers' responses to the conflict, this seminar analyses these claims under international law with the aim of assisting South African public debate.
